Danny agrees that Bijou Phillips should have custody of their 9-year-old daughter.

Legal documents obtained by TMZ indicate Danny's agreement to grant both legal and physical custody to Bijou.

The couple's date of separation is listed as September 15, shortly after Danny's sentencing to 30 years.

Danny and Bijou were married for 11 years, having tied the knot in October 2011.
